    PROHIBITION OF SEXUAL CONTACT AND INVOLVEMENT

     

    District employees, and all persons on school grounds or at school-sponsored activities, are expressly prohibited from having any sexual contact and/or sexual involvement with any student.  This policy is in effect on school grounds, at any school-sponsored activity, at any activity which bears a reasonable relationship to school, at any other time for an adult employed by the District and applies to interactions and communications that take place involving in-person contact between individuals, written communication or via any form of electronic transmission or communication.

     

    COMPLAINT AND INVESTIGATIVE PROCEDURE

     

    A student who believes that he or she may have been subject to sexual contact or sexual involvement with a District employee at any time or any other adult present on school grounds, whether the contact or involvement involved in-person contact, written communication or occurred via any form of electronic transmission, must report the matter to a staff member, teacher, counselor, principal or the superintendent.  The person to whom such a report is made will advise the principal and superintendent immediately of such a report.

     

    As mandated reporters under the Abused and Neglected Child Reporting Act, all school employees are required to cause a report to be made whenever they have reasonable cause to believe that a child known to them may be abused or neglected. When reasonable cause is present, the principal shall report the alleged behavior and/or involvement immediately to the Illinois Department of Children and Family Services (IDCFS) and the Superintendent.  In cases where the principal is alleged to have committed the sexual contact and/or involvement, the Superintendent shall report the alleged behavior and/or involvement immediately to the IDCFS.  Only after the report has been made will an investigation by the school or any employee of the school or school District commence.  A record of the entire timeline of the receipt of the alleged incident, the report to the IDCFS, and the investigation shall be retained in a confidential file by both the principal and the superintendent.

     

    Following the report to the IDCFS, a District or school administrator will conduct a prompt investigation into the complaint.  As appropriate, that investigation will consist of interviews with the complaining party, the alleged offender and any witnesses suggested by either the complaining party or the alleged offender.  To the extent possible, the investigation will be conducted to protect the confidentiality of all parties.  The District will cooperate fully with all law enforcement agencies as directed by IDCFS and District counsel.

     

    Within ten working days from the date the complaint was received, the investigator will produce a report to the principal and/or the superintendent which will include at a minimum the following:

     

    1. the date the complaint was received;
    2. the complainant’s name;
    3. the name of the alleged violator and a description of all conduct that gave rise to the complaint (written, signed statements by complainants describing relevant events should be obtained whenever possible);
    4. the date and time of the report to IDCFS and the name of the IDCFS person who received the report.
    5. a statement detailing the scope of the investigation undertaken, including the names of all witnesses interviewed and the results of the interviews;
    6. a statement as to whether any additional investigation is required; and
    7. a statement of corrective measures recommended.

     

    DISCIPLINARY ACTION

     

    Any District employee who is determined, after an investigation, to have engaged in sexual contact or sexual involvement with a student in violation of this policy will be subject to disciplinary action up to and including discharge.  In the event of sexual contact and/or involvement by adults other than District employees, the District will take reasonable steps to manage the risk of this activity occurring in the future.

     

    Any student who knowingly makes a false accusation regarding sexual contact or involvement will be subject to disciplinary action, up to and including expulsion.
